Please notify the Company immediately of any changes to your personal data so that the information in our files is always up-to-date and accurate. Furthermore, by accepting this Privacy Policy, you acknowledge that the information and personal data collected are accurate and truthful. Your personal data is collected for the purpose of processing your booking requests and sending you advertising for products and services and commercial information of interest through our Newsletter service. Within our Newsletter section, you can modify or access your data or unsubscribe at any time by selecting the corresponding button. The Company undertakes to treat your personal data with absolute confidentiality and to use it only for the purposes indicated. We also inform you that the Company has implemented the necessary technical and organizational security measures to guarantee the security of your personal data and prevent its alteration, loss, and unauthorized processing and/or access, taking into account the state of technology, the nature of the stored data, and the risks to which it is exposed, whether from human action or the physical and natural environment. All of this is in accordance with the provisions of the Spanish Organic Law on Data Protection (LOPD) and its implementing regulations (RLOPD). For the purposes of Article 11 of the LOPD, and considering the nature of the products and services to which the Company grants you access, both nationally and internationally, by accepting this Privacy Policy, you consent to your data being shared with any of the Company's partner entities in order to provide and offer the services you have requested and process them (managing reservations and collecting payments for services), send information and advertising about offers and promotions, and conduct surveys, statistical analyses, and market trend analyses. In accordance with Article 34.e) of the LOPD, you consent to the Company transferring your personal data to the recipients and under the terms and conditions indicated above, to any country in the world, including those that do not offer a level of protection equivalent to that of the LOPD.
Cancellation policy
1. General aspects
The company reserves the right to cancel the activity at any time and without prior notice, due to weather conditions or force majeure, without any applicable compensation. The client authorizes the company to take photographs and videos of the activity, as well as to publish them on its website(s) and social media.
All damages that the client may cause to the vessels or equipment, in addition to the loss of material, will be the responsibility of the client or contractor, who must pay 100% of the costs for repair, renewal or replacement of the same.
2. Cancellations
The customer will only be entitled to a refund of the amounts paid in case of cancellation, without any right to compensation.
Due to adverse weather conditions, we will attempt to reschedule for another day at no additional cost. If a rescheduling is not possible, the customer will receive a full refund.
Cancellation, delay, or non-attendance at the activity by the client will result in the total loss of all amounts paid, as compensation for damages. If the client is unable to attend due to any circumstances, including force majeure, they may reschedule their booking at no additional cost; otherwise, they will forfeit all amounts paid.
It can only be cancelled 7 days in advance to receive a refund. This can be done by sending an email to info@belivecharter.es or a signed written request addressed to the data controller BE LIVE CHARTER FORMENTERA S.L., located at Passeig de la Marina 2, 1st floor (Formentera 07860).
3. Refund
We will issue a refund directly or to a different payment method in the name of the person who made the reservation. The full amount paid will be refunded less a 10% administration fee (therefore, 90% of the money paid will be refunded).
4. Acceptance
Making the payment implies acceptance of the conditions set out above.
